Agro-food. Protect the manufacturer and supply chain.
From the farm to marketing: trademarks, packaging, technical solutions and chain agreements require a coordinated reading.
From production to the brand.
Primary production introduces specific needs: manufacturer identity, declared origin, relationships with transformers and distributors and process information management. The company trademark should not be confused with a name of origin or a geographical indication. Food & Beverage focuses on food processing and beverages.
Manufacturer name and product lines
Evaluate the sign used on the products, catalogues and direct sale, with attention to the ownership and uses already started.
Packaging and presentation
Collect projects, photographs, labels and agreements with designers to reconstruct the creation and use of distinctive elements.
Processes and information of supply chain
Document who develops solutions, what information must remain confidential and how it is shared between producer, transformer and partner.
Origin and distinctive signs
Before using references to the origin, collective signs or references to PDO and PGI you must check the requirements and rules applicable to the concrete product. The registration of a trademark does not automatically confer the right to use a protected name.
A possible path.
A manufacturer prepares a new line for direct sales and via a distributor. The comparison starts from the chosen name, from the labels and the chain agreements, distinguishing the company brand from the indications of origin.
Illustrative example, unreported to a LegalMark assignment.
Documents to start.
- Agricultural and processed products marketed
- Names, labels and sales channels
- Titularity of projects and chain agreements
- Origin of products and target markets
Agrofood and Food & Beverage coincide?
The areas are connected but have a different focus: Agro-food includes primary production and chain relations; Food & Beverage deepens food industries, beverages and related brands.
