European Union mark: differences with respect to the Italian mark

What changes between national protection and the European Union’s trade mark and how to link the choice to business markets.

The main difference between an Italian national trade mark and a European Union trade mark is the territorial protection system and the competent office.

Italian mark

The national application concerns protection in its order. For Italy the institutional reference is UIBM.

March of the European Union

The EU trade mark is managed by the EUIPO and operates according to a unitary system of the European Union. It is a choice to be assessed in relation to current markets and to those provided for in the project.

How to choose?

The decision should not be taken only on the basis of the cost of the application. It is useful to consider expected expansion, classes, prior rights, group structure and brand strategy.
